A man serving a life sentence for the murder of a 26-year-old in southwestern Nova Scotia is seeking a new trial.
Robert Rogers is appealing his second-degree murder conviction with no chance of parole for 19 years.
The Yarmouth man will stand in front of a panel of three judges at the Nova Scotia Court of Appeal on Tuesday.
The court says the appeal is on the ground the Supreme Court judge made errors when providing instructions to the jury about the testimony of the key Crown witness.
Colton Cook was shot and stabbed to death at a residence in South Ohio, Yarmouth County in September, 2020.
His remains were found days later on Saunders Road.
Two others were also convicted in the case….
Wayne Crawford was sentenced to life in prison with no parole for 10 years, while Keith Siscoe Jr. was given three years for accessory after the fact.
