The crown has filed an appeal in the acquittal of the taxi driver accused of sexually assaulting a woman who had blacked out in the back of his cab.
Judge Gregory Lenehan said the crown did not prove the woman didn’t consent to have sexual relations with Bassam Al Rawi.
The crown lists that as one of the grounds to appeal the decision.
Others include: the judge failing to give legal effects to the facts presented and that Lenehan erred in his interpretation and application of the test for capacity to consent.

News of the appeal came shortly before hundreds of people rallied in Halifax’s Grand Parade to protest the judge’s decision.
A petition to appeal the acquittal and investigate Lenehan’s decision has gathered over 35,000 signatures.
